1. Agreement to These Terms 

1.1 The Company 

These Terms of Service (the "Terms") constitute a binding legal agreement between you and [LEGAL NAME], tax identification number (NIF/CIF) [NUMBER], registered address [ADDRESS], Spain (the "Company," "we," "us," or "our"). The Company is the sole owner and operator of the Service. 

1.2 Definitions 

For the purposes of these Terms: 

"Service" means the Soma anatomy learning application, its associated website, and all related services, features, and content made available by the Company, whether accessed by web browser, mobile application, or any other platform. 

"You" and "your" mean any individual who accesses, registers for, or uses the Service, whether as a free user or a paid subscriber (a "User"). 

"Account" means the personal, credential-protected account a User creates to access the Service. 

"Content" means all text, questions, answer explanations, images, diagrams, roadmaps, difficulty classifications, software, and other material made available through the Service, excluding Your Content. 

"Your Content" means any material a User submits to the Service, including display names, free-text answers, question reports, feedback, and correspondence. ● "Subscription" means any paid, recurring plan offered through the Service. ● "Consumer" means a User acting for purposes outside their trade, business, craft, or profession, as defined under applicable consumer protection law. 

"Affiliate" means any entity that controls, is controlled by, or is under common control with the Company. 

1.3 Nature of the Service 

The Service is an educational software application designed to assist Users in the study of human anatomy through structured content, adaptive question delivery, progress tracking, and related gamified features. 

The Service is a study aid. It is not a medical device, a clinical reference tool, or a source of medical advice, and it does not constitute an accredited course of instruction. §7

governs the scope and limitations of the Service's educational purpose in full and prevails over any general description of the Service appearing elsewhere, including on the Company's website, in application-store listings, or in marketing materials. 

1.4 Incorporation of the Privacy Policy 

The Company's Privacy Policy, available at [LINK], is incorporated into these Terms by reference and forms part of the agreement between you and the Company. Where these Terms and the Privacy Policy conflict on a matter of data protection, the Privacy Policy governs; on all other matters, these Terms govern. 

1.5 IMPORTANT NOTICE: PLEASE READ BEFORE ACCEPTING 

The provisions summarised below materially affect your legal rights. This summary is provided for your convenience. It does not replace the full provisions referenced, each of which applies in full and remains subject to applicable law. Nothing in this Section limits any right or remedy that cannot lawfully be waived, excluded, or limited. 

(a) Arbitration and class action waiver (United States Users only). If you reside in the United States, §13.5 generally requires disputes between you and the Company to be resolved by binding individual arbitration rather than in court. To the extent permitted by applicable law, you and the Company waive the right to have covered disputes decided by a judge or jury, and the right to participate in any class, collective, or representative action or arbitration. §13.5 sets out the disputes covered, the small-claims-court exception, and how and by when you may opt out. This provision does not apply to Users residing outside the United States. 

(b) Limitations of liability. §10 excludes and limits certain liabilities arising from or relating to the Service and imposes an aggregate monetary cap on the Company's liability to you of EUR 100. These exclusions and limitations apply only to the extent permitted by applicable law and do not exclude or limit liability, or Consumer rights, that cannot lawfully be excluded or limited. 

(c) Educational service; no medical or clinical use. As set out in §7, the Service is provided for general educational purposes only. It does not provide medical advice, diagnosis, treatment, or clinical decision-making, and must not be relied upon as a substitute for the judgment of a qualified healthcare professional or for accredited instruction and supervised clinical training. The Service does not award, guarantee, or prepare you for any academic, professional, or clinical qualification or certification. 

(d) Automatic renewal of Subscriptions. As set out in §8, a Subscription renews automatically at the end of each billing period and the payment method on file will

be charged, unless you cancel before the renewal date. The price, billing frequency, renewal terms, and cancellation method will be presented to you before purchase. 

(e) Minimum age. The Service is subject to the minimum age and capacity requirements set out in §2.
